§ 26-8A-6 — Report of abuse or neglect by hospital personnel--Failure as misdemeanor--Written policy required.

South Dakota·Title 26 MINORS·Ch. 26-8 PROTECTION OF CHILDREN FROM ABUSE OR NEGLECT
Any person who has contact with a child through the performance of services as a member of a staff of a hospital or similar institution shall immediately notify the person in charge of the institution or his designee of suspected abuse or neglect. The person in charge shall report the information in accordance with the provisions of § 26-8A-8 . Any person required by this section to report shall also promptly submit to the state's attorney complete copies of all medical examination, treatment, and hospital records regarding the child. Any person who knowingly and intentionally fails to make a required report and to submit copies of records is guilty of a Class 1 misdemeanor.
