§ 13-8-25 — Appointment to fill vacancy on school board--Qualification and term of appointee.

South Dakota·Title 13 EDUCATION·Ch. 13-5 SCHOOL BOARDS AND SCHOOL DISTRICT OFFICERS

Any vacancy occurring on a school board shall be filled by appointment. The vacancy shall be filled by all school board members, including the vacating member, if the vacancy is created by:

(1)A school district's failure to elect a person to succeed a school board member whose term has expired;
(2)An elected school board member's failure to qualify as specified in § 13-8-14 ; or (3) A school board member's resignation. If the vacancy occurs due to an event listed in subdivisions 13-8-23(1), (2), (4), (5), (6), (7), or (8), the vacancy shall be filled by the remaining school board members. The appointee shall qualify as if elected at or before the next school board meeting, and serve until the next succeeding election at which time a successor shall be elected to serve the unexpi
