Text

The Transportation Commission may adopt rules, pursuant to chapter 1-26 , governing the following elements in granting written approval for access to state highways as provided for in §§ 11 - 3-12.1 and 31-24-6 :

(1)Access location, width, and spacing;
(2)Signal spacing;
(3)Median design;
(4)Access application process;
(5)Access construction standards; and (6) Safety. Nothing in the rules promulgated pursuant to this section supersedes county or municipal planning and zoning authority.
