§ 40-8-35 — Cemetery contract disclosure requirements.
South Carolina·Title 40 PROFESSIONS AND OCCUPATIONS·Ch. 8 SOUTH CAROLINA PERPETUAL CARE CEMETERY ACT
The cemetery contract must disclose to the consumer:
(1)the type of outer burial container being purchased (a Category I, Protective Outer Burial Container, or a Category II, Nonprotective Outer Burial Container);
(2)that the outer burial container either has a warranty or that it does not have a warranty; and (3) if the outer burial container purchased in advance of need is not available at the time of need, the cemetery shall make available to the purchaser or his representative an outer burial container of equal or greater value. The purchaser or his representative is entitled to approve any substitutions.
