§ 58-27-1125 — Storm recovery property; security interests; sale, assignment, or transfer of storm recovery property.

(A)Provisions applicable to storm recovery property:
(1)All storm recovery property that is specified in a financing order constitutes an existing, present intangible property right or interest therein, notwithstanding that the imposition and collection of recovery charges depends on the electrical utility to which the financing order is issued performing its servicing functions relating to the collection of recovery charges and on future electricity consumption.
