(A)The governing bodies of the members of a joint system shall form an agreement specifying the number of commissioners each member may appoint to a commission created to govern the joint system pursuant to Section 6-25-60.
(B)Two or more commissioners shall file with the Secretary of State an application signed by the commissioner of each proposed member setting forth:
(1)the names of all proposed members and their respective appointed commissioners;
(2)a certified copy of:
(a)the resolution of each member determining it is in its best interest to participate in the proposed joint system; and (b) the resolution appointing the member's commissioner;
(3)the desire that the joint system be organized as a public body corporate and politic under this chapter;
(4)the name which is propos

HISTORY: 1983 Act No. 82 SECTION 2; 1999 Act No. 113, SECTION 8; 2007 Act No. 59, SECTION 1, eff June 6, 2007. Effect of Amendment The 2007 amendment designated the first sentence as subsection (A) and rewrote it; designated the second sentence and items (a) to (e) as subsection (B), redesignated items (a) to (e) as paragraphs (1) to (5) and substituted "commissioner" for "representative" throughout; and made nonsubstantive changes in the second and third undesignated paragraphs.
