§ 42-63.5-5. Consent to condemnation — Real property requirements.
The state gives its consent, as required pursuant to § 42-64-9(a), to the condemnation by the EDC of any interest in any parcels of land within the
Project Site which are owned by the state or any state agency, subject, in the case
of parcels under the control of the department of transportation, to:
(1)approval
by the department to protect the integrity of highways or other related structures
and the public safety relating thereto, and (2) receipt by the department of the value

of the state or the EDC who act affirmatively to carry out the purposes of this chapter
and implementation of the development of the Providence Place Project, shall not be
diminished by the provisions of this section, including for example and without limitation,
those officers as the director of administration and the executive director of the
EDC, and actions such as execution and delivery of: (1) a deed or deeds to the EDC
for all or any portion of the Project Site, (2) the Public Investment and HOV agreement,
(3) the Ground Lease, and (4) the agreement regarding Providence Place Mall, as well
as any other documents or certificates necessary or desirable to effect and carry
out the development and construction of the Providence Place Project.
