§ 42-29-17. Judgment for costs against defendant.
If the defendant shall recover judgment for costs, execution shall issue therefor
            against the person for whose use the suit is brought, and not against the general
            treasurer or sheriff, and the surety for costs of such person, if any there be, shall
            be liable for such costs as such sureties are in other cases.
