§ 42-20-13. Right of appeal — Power to recover penalties.
The right of appeal to a court of competent jurisdiction as provided by law shall
            not be abridged or impaired by the passage of this title. The right of the head of
            any department or any subdivision thereof to prosecute for any offense to recover
            a penalty or forfeiture as provided by law for any department, division, board, commission,
            or officer shall henceforth be vested in the head of the department as set forth in
            this title.
