§ 42-17.1-1. Department established.
There is hereby established within the executive branch of the state government a
            department of environmental management. The head of the department shall be the director
            of environmental management, who shall be in the unclassified service and who shall
            be appointed by the governor, with the advice and consent of the senate, and shall
            serve at the pleasure of the governor.
