§ 18-4-9. Powers of surviving fiduciaries.
(a) Where a power or trust, whether discretionary or not, is given to or vested in two
(2)or more executors, administrators, trustees, or assignees, jointly, then, unless
the contrary is expressed in the instrument, if any, creating the power or trust,
the power or trust may be exercised or performed by the survivors or survivor of them,
or those occupying these positions for the time being.
(b) This section shall only apply to powers and trusts created after January 31, 1896.
