§ 11-5-6. Assault and battery in the collection of a loan.
Any person who commits an assault and battery upon another for the purpose of collecting
            any loan shall be punished upon the first conviction by imprisonment for not more
            than five (5) years and upon a second or subsequent conviction by imprisonment for
            not less than three (3) years nor more than ten (10) years.
