§ 11-49.1-4. Penalties.
(a) Every person who violates the provisions of § 11-49.1-3 shall be imprisoned for not more than three (3) years and may be fined not more than
            five thousand dollars ($5,000), or both, for a first conviction.
         
(b) Every person who violates the provisions of § 11-49.1-3 may be imprisoned for not less than three (3) years nor more than five (5) years
            and shall be fined not more than ten thousand dollars ($10,000), or both, for a second
            conviction.
         
(c) Every person who violates the provisions of § 11-49.1-3 shall be imprisoned for not less than five (5) years nor
