Text
(1)Except as provided in this section, reimbursement from the client security fund is discretionary with the board of governors.
(2)The board shall not authorize payment unless the conditions of ORS 9.655 (1) have been found to exist. However, the board may, in its sole discretion, waive one or more of the conditions of ORS 9.655 (1) in cases of extreme hardship or special and unusual circumstances. The state bar is subrogated, in the amount that a client’s claim is reimbursed from the client security fund, to all rights and remedies of that client against the licensee whose dishonest conduct caused the loss, against the estate of the licensee or against any other person liable for the loss.
