Each person who packs or prepares for shipment to any point within this state, or who delivers or causes to be delivered to any express agent or railroad agent or other person or to any transportation company or corporation for shipment to any point outside of this state, any fresh, cured or dried fruit infected with insects or other plant pests injurious to trees, shrubs, plants, fruits or vegetables is guilty of a misdemeanor. This section does not prevent the grower of infected fruit grown within this state from manufacturing the fruit into a by-product or selling and shipping the fruit to a by-product factory.
