The Department of Consumer and Business Services may:

(1)Where it appears that a person is engaging in or is about to engage in an act or practice in violation of any provision of ORS 480.510 to 480.670, obtain without furnishing a bond, a restraining order and injunction from the circuit court in the county where the act or practice is occurring, or is threatened, enjoining the act or practice. However, before obtaining a restraining order and injunction, unless the act or practice constitutes an immediate threat to health and safety, the department shall first notify the person concerned of the department’s intentions. The notice shall be in writing, shall advise the person concerned of the department’s intentions and shall advise the person concerned of the right to appeal in writing w
