(1)The Environmental Quality Commission shall establish by rule an annual fee, which must be reasonably calculated to cover the costs to the Department of Environmental Quality of implementing, administering and enforcing ORS 459A.305 to 459A.355.

(2)The commission shall establish by rule a one-time plan review fee reasonably calculated to cover the costs to the department of reviewing the initial electronics producer responsibility program plan submitted to the department for approval under ORS 459A.321 by each electronics producer responsibility organization. The department may not approve an initial plan under ORS 459A.321 if the electronics producer responsibility organization has not paid the fee required by this subsection.
