CRIMINAL PENALTY.

A.An athlete agent who violates Section 14 of this act is guilty of a misdemeanor and, upon conviction, shall be subject to a fine of not less than Ten Thousand Dollars ($10,000.00) and not more than Two Hundred Fifty Thousand Dollars ($250,000.00), or to imprisonment not to exceed one (1) year, or to both such fine and imprisonment.
B.An athlete agent who violates Section 14 of this act upon a second or subsequent conviction shall be guilty of a felony and subject to a fine of not less than Fifty Thousand Dollars ($50,000.00) and not more than Five Hundred Thousand Dollars ($500,000.00), or to imprisonment not to exceed three (3) years, or to both such fine and imprisonment.
