endorsement exception. Any person driving under a commercial class A license shall not be required to obtain a hazardous material endorsement pursuant to 49 C.F.R. Section 383 if the person is: 1. Acting within the scope of the license holder's employment as an employee of a custom harvester operation; and 2. Operating a service vehicle that is: a. transporting diesel in a quantity of three thousand seven hundred and eight-five (3,785) liters, or one thousand (1,000) gallons or less, and b. clearly marked with a "flammable" or "combustible" placard, as appropriate.
