A.There is hereby created in the State Treasury a revolving fund for the Oklahoma Department of Agriculture, Food, and Forestry to be designated the Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund. All monies accruing to the credit of the Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund are hereby appropriated and may be budgeted and expended by the Department for the purposes set forth in subsection C of this section. The fund shall be a continuing fund not subject to fiscal year limitations and shall consist of: 1. All monies received by the Department for sheltering of seized animals pursuant to the Commercial Pet Breeders and Animal Shelter Licensing Act; and 2. A. All monies accruing to the credit of the Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund are hereby appropriated and may be budgeted and expended by the Department for the purposes set forth in subsection C of this section. The fund shall be a continuing fund not subject to fiscal year limitations and shall consist of: 1. All monies received by the Department for sheltering of seized animals pursuant to the Commercial Pet Breeders and Animal Shelter Licensing Act; and 2. Money received by the Department in the form of gifts, grants, reimbursements, or from any other source intended to be used for the purposes specified by or collected pursuant to the provisions of this section of the Commercial Pet Breeders and Animal Shelter Licensing Act. B. The monies deposited in the Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund shall be excluded from budget and expenditure limitations and shall at no time become part of the general budget of the Department or any other state agency. Except as provided for in this section, no monies from the Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund shall be transferred for any purpose to any other state agency or any account of the Department or be used for the purpose of contracting with any other state agency or reimbursing any other state agency for any expense. C. The Commercial Pet Breeders and Animal Shelter Assistance Revolving Fund shall be utilized for defraying veterinary costs for animals in the event of a removal of animals from an animal shelter or commercial pet breeder. The fund may, in the discretion of the State Board of Agriculture, also be used to defray costs associated with care of animals including, but not limited to, feed and shelter.
