Text

No person shall operate a commercial composting facility without a valid permit issued by the Department of Environmental Quality. The Environmental Quality Board shall adopt rules establishing requirements for the permitting and operation of commercial composting facilities. Such rules shall include, without limitation, requirements relating to: 1. Applicant disclosure information; 2. Siting; 3. Design, construction and operation; 4. Water protection and water management, including groundwater monitoring and stormwater control; 5. Closure; and 6. Financial assurance for the proper management and removal of all of the feedstock and product material that the site is capable of storing.
