§ 2-8-77.10 — Plant nutrient deficiency - Payments.

A.A payment of two (2) times the value of the deficiency or deficiencies shall be assessed: 1. If the analysis shows that a fertilizer is deficient in one of its guaranteed primary plant nutrients beyond the investigational allowances and compensations as established by rules; or 2. If the overall commercial value of the fertilizer is below the level established by rule, a penalty payment of two (2) times the value of the deficiency or deficiencies shall be assessed.
B.When a fertilizer is subject to a penalty payment under subsection A of this section, the larger penalty payment shall apply.
C.All penalty payments assessed under this subsection A of this section shall be paid by the registrant or licensee to the consumer of the lot of fertilizer represented by the sample analyzed withi
