§ 2-5-60.20 — Determination of election results.

A.Upon receiving the report of the returns of an election and referendum, the Commissioner shall determine: 1. The number of votes cast for and against the referendum proposition; 2. The total volume of production of the commodity during the relevant production period; 3. The percentage of the total volume of production of the commodity that was produced by those voting in favor of the referendum proposition; and 4. The appropriate number of candidates receiving the highest number of votes for membership on the commodity producers board.
B.A successor organization shall follow the board election procedures set in the bylaws of the successor organization and the statutory assessment provisions for the particular commodity represented by the successor organization.
