Text

— Penalties.

A.Any individual entering through gates used for ingress or egress to a property designated as an easement shall maintain the position of the gate upon use. B.
1.Any individual who violates the provisions of subsection A of this section shall, upon conviction, be guilty of a misdemeanor punishable by a fine not more than Five Hundred Dollars ($500.00), by imprisonment in a county jail for not more than ninety (90) days, or by both such fine and imprisonment.
2.Any individual convicted of a second offense shall, upon conviction, be guilty of a misdemeanor punishable by a fine not more than One Thousand Dollars ($1,000.00), by imprisonment in a county jail for not more than one hundred eighty (180) days, or by both such fine and imprisonment.
