(A)Except as provided in division (B) of this section, whenever the director of agriculture has cause to believe that a person has violated, or is violating, sections905.31to905.503of the Revised Code or rules or an order issued under those sections or rules, the director may conduct a hearing in accordance with Chapter 119. of the Revised Code to determine whether a violation has occurred. If the director determines that a violation has occurred, the director may require the violator to pay a civil penalty in accordance with the schedule of civil penalties established in rules. Each day of violation constitutes a separate violation.
(B)A person who fails to comply with rules adopted under division (A)(2)(f) of section905.322of the Revised Code is not subject to division (A)
