Text

The department of medicaid may enter into a provider agreement as provided in section5165.07of the Revised Code, rather than section5165.511or5165.512of the Revised Code, with an entering operator if the entering operator does not agree to a provider agreement that satisfies the requirements of division (A)(3) of section5165.513of the Revised Code. The department may not enter into the provider agreement unless the department of health certifies the nursing facility for participation in medicaid. The effective date of the provider agreement shall not precede any of the following:

(A)The date that the department of health certifies the nursing facility;
(B)The effective date of the change of operator;
(C)The date the requirement of section5165.51of the Revised Code is satisfied.
