Whoever violates division (F) of section5153.176of the Revised Code shall be punished as follows:
(A)Except as otherwise provided in division (B) of this section, the person is guilty of a misdemeanor of the fourth degree.
(B)The person is guilty of a misdemeanor of the first degree if, during the period between the violation and the conviction of or plea of guilty by the person for that violation, the license holder who is the subject of the investigation about which the person fails to provide information inflicts on any child attending a school district, educational service center, public or nonpublic school, or county board of developmental disabilities where the license holder works any physical or mental wound, injury, disability, or condition of a
