(A)(1) Not later than ninety days after January 1, 1997, the department of rehabilitation and correction shall adopt standards that it will use under this section to assess the following criminal offenders and may periodically revise the standards:
(a)A criminal offender who is convicted of or pleads guilty to a violent sex offense or designated homicide, assault, or kidnapping offense and is adjudicated a sexually violent predator in relation to that offense;
(b)A criminal offender who is convicted of or pleads guilty to a violation of division (A)(1)(b) of section2907.02of the Revised Code committed on or after January 2, 2007, and either who is sentenced under section2971.03of the Revised Code or upon whom a sentence of life without parole is imposed under division (B) of section290
