Text

(A)If the holder of a license or certificate issued under this chapter violates division (A), (B), or (C) of section4731.66or section4731.69of the Revised Code, or if any other person violates division (B) or (C) of section4731.66or section4731.69of the Revised Code, the state medical board, pursuant to an adjudication under Chapter 119. of the Revised Code and an affirmative vote of not fewer than six of its members, shall:
(1)For a first violation, impose a civil penalty of not more than five thousand dollars;
(2)For each subsequent violation, impose a civil penalty of not more than twenty thousand dollars and, if the violator is a license or certificate holder, proceed under division (B)(27) of section4731.22of the Revised Code.
