If no solid waste disposal facilities are located within a county or joint solid waste management district that has entered into, or proposes to enter into, an agreement with another county or joint solid waste management district under section343.02of the Revised Code for the joint use of solid waste facilities, the latter district may levy fees under division (B)(2) of section3734.57of the Revised Code on the disposal of solid wastes at solid waste disposal facilities within its boundaries that were generated within the former district. Such a district may levy those fees regardless of whether it is levying fees under division (B) of section3734.57of the Revised Code pursuant to that division or division (A) or (D) of section3734.574of the Revised Code.
