The director of health may not deny a nursing home license to a facility seeking a license under this chapter as a nursing home on the grounds that the facility does not satisfy a requirement established in rules adopted under section3721.04of the Revised Code regarding the toilet rooms and dining and recreational areas of nursing homes if all of the following requirements are met:

(A)The facility seeks a license under this chapter because it is a county home or district home being sold under section5155.31of the Revised Code to a person who may not operate the facility without a nursing home license under this chapter.
(B)The requirement would not have applied to the facility had the facility been a nursing home first licensed under this chapter before October 20, 2001.
