Text

Whoever violates section3113.06of the Revised Code is guilty of a misdemeanor of the first degree. If the offender previously has been convicted of or pleaded guilty to a violation of section3113.06of the Revised Code or if the court finds that the offender has failed to pay the cost of child maintenance under section3113.06of the Revised Code for a total accumulated period of twenty-six weeks out of one hundred four consecutive weeks, whether or not the twenty-six weeks were consecutive, a violation of section3113.06of the Revised Code is a felony of the fifth degree.
