§ 35. Resources of fund. 1.
(a)There shall be paid into the fund any\nand all moneys received by the state from the federal government in\npayment of its share, pursuant to the applicable provisions of title\ntwenty-three, United States Code, of the cost of construction of said\nsection as it exists on the sixth day of July, nineteen hundred\nsixty-six.\n (b) The sum of two million five hundred thousand dollars ($2,500,000),\nor so much thereof as may be necessary, is hereby appropriated in the\nfirst instance out of any moneys in the state treasury in the general\nfund to the credit of the state purposes fund, not otherwise\nappropriated, to the Niagara thruway toll removal fund for the purposes\nof this article. No part of the appropriation hereby made shall be\navailable until a certificate of approval of availability shall have\nbeen issued by the director of the budget and a copy of such certificate\nfiled with the state comptroller, the chairman of the senate finance\ncommittee and the chairman of the assembly ways and means committee.\nSuch certificate may be amended from time to time by the director of the\nbudget and a copy of each such amendment shall be filed with the state\ncomptroller, the chairman of the senate finance committee and the\nchairman of the assembly ways and means committee.\n 2. The fund shall pay over annually from moneys made available to it\nfrom any source to the New York state thruway authority an amount equal\nto an amount sufficient to amortize that portion of the debt service of\nthe authority allocable to the Niagara section of said thruway\nauthority; provided, however, an agreement shall be entered into between\nthe fund, the commissioner of transportation, the thruway authority and\nthe bureau of public roads of the United States department of\ntransportation providing: for the aforesaid annual payments by the fund\nto the thruway authority; that the federal government make the payments\nprovided under paragraph (a) of subdivision one of this section; that\nsuch tolls shall be removed as of the time of the first of such payments\nto the thruway authority; that such tolls shall not be collected so long\nas such annual payments are made; and further that the thruway authority\nshall operate and maintain such section in the same manner as on the\nsixth day of July, nineteen hundred sixty-six.\n
