§ 34. Cession during use for purposes thereof, with sundry\nreservations. Title and jurisdiction of the following described tracts\nor parcels of land has been ceded to the United States by this state on\ncondition that the jurisdiction so ceded should not prevent the\nexecution on such tracts of any process, civil or criminal, issued under\nthe authority of this state, nor prevent the laws of this state, not\nimcompatible with the purposes for which such cession was made from\noperating within the bounds of such tracts, and that the jurisdiction of\nthe United States shall continue so long only as such tracts shall be\napplied to the use of providing for the defense and safety of this\nstate:\n Three separate tracts of land in the county of Oneida, the county of\nAlbany and the county of Clinton, the first of which is described as\nfollows: "All that certain piece or parcel of land situate in the\nvillage of Rome, county of Oneida, and state of New York, on which the\narsenal, armory and other buildings belonging to the United States, are\nerected, distinguished as lots Nos. 4, 5, 6, 13, 14 and 15, in block No.\n6 of said village, lying contiguous and forming one entire lot, and is\nbounded as follows, to wit: Beginning at the northwesterly corner of lot\nNo. 7, in said block No. 6, and running thence westerly on the line of\nDominick street, N. 36Á 20' W., in 1796, 198 feet, to the northeasterly\ncorner of lot No. 3 in said block No. 6; thence at right angles with\nDominick street, southerly, 432 feet, to the south bank of the canal\nconnecting Wood creek with the Mohawk river; thence easterly on the\nnorth bank of said canal to the southwesterly corner of lot No. 12 in\nsaid block No. 6, 216 feet; thence running northerly at right angles\nwith Dominick street to the place of beginning, 340 feet. Also, lot No.\n5 in block No. 7 bounded as follows, to wit: Beginning at the\nsouthwesterly corner of lot No. 6 in block No. 7, and running thence\nwesterly on the line of Dominick street, 66 feet to the southeasterly\ncorner of lot No. 4, in said block No. 7; thence northerly at right\nangles with Dominick street, 200 feet, to the southerly line of Stone\nalley; from thence easterly on the southerly line of Stone alley, and\nparallel to Dominick street, 66 feet; from thence at right angles with\nDominick street, 200 feet, to the place of beginning." The second of\nsaid tracts is described as follows: "And also all that certain piece or\nparcel of land situate in the town of Watervliet, in the county of\nAlbany, and state aforesaid, at the place called Gibbonsville, on which\nis also erected an arsenal and other buildings belonging to the United\nStates bounded as follows, to wit: Beginning at an elm tree standing on\nthe bank of Hudson's river in the village of Gibbonsville, thence\nrunning by the true meridian (the variation of the magnetic needle being\ncalculated at 5Á 30' to the west of north), north 75 1/2Á W., 11 chains\nand 35 links; thence S. 14 1/2Á W., 3 chains and 86 links; thence N. 75\n1/2Á W., 7 chains and 75 links; thence S. 14 1/2Á W., 3 chains; thence\nS. 75 1/2Á E., 7 chains and 75 links; thence S. 14 1/2Á W., 3 chains and\n71 links; thence S. 75 1/2Á E., 11 chains and 35 links, to the bank of\nHudson's river; thence S. 75 1/2Á E., to the main channel of the said\nriver; thence northerly along said channel to intersect a line drawn S.\n75 1/2Á E., from the first station; and then N. 75 1/2Á W., to the place\nof beginning." The third of such tracts is described as follows: "Lots\nNos. 61, 62, 63, 64, 65 and 66 of the 80 acre lots in the tract granted\nto the Canadian and Nova Scotia refugees, containing in the whole 480\nacres, and also over a tract of 9 acres 3 roods and 5 poles, being the\neast end or front of lot No. 60 in the same tract; which tracts are\nsituated at Rouse's Point in the county of Clinton, on the west bank of\nLake Champlain"; acquired for the defense and safety of the state.\n
