§ 22. Cession with reservation of right to serve process. Title and\njurisdiction to the following described tracts or parcels of land have\nbeen ceded to the United States by this state on condition the\njurisdiction so ceded should not prevent the execution thereon of any\nprocess, civil or criminal, issued under the authority of the state,\nexcept as such process might affect the property of the United States\ntherein:\n 1. Montock point, Suffolk county. A tract of land at Montock point, in\nthe county of Suffolk, known by the name of Turtle hill, and bounded as\nfollows: "Beginning at the beach, and at a rock lying on a hommock, at\nthe bottom of the said hill, and runs thence N. 82Á W., 11 chains and\n58 links; thence S. 5Á W., 5 chains; thence S. 15Á E., 9 chains, to a\nrock marked John Champlain, 1788; thence on the same course to low water\nmark; thence northeasterly along low water mark, until the point of\nbeginning bears N. 82Á W.; thence to the place of beginning," acquired\nfor the erection of a light-house thereon.\n 2. In Huntington, Suffolk county. "All that certain lot, piece or\nparcel of land at the northern extremity of Eaton's neck, in the town of\nHuntington, in the county of Suffolk, beginning at the northernmost\npoint thereof, upon the shore at high water, which is distant from a\nstone fixed in the ground and bears N. 12Á W., 2 chains and 24 links;\nthence along the high water line of the shore S. 75Á W., 12 chains and\n75 links; thence S. 12Á E., 2 chains and 45 links to a stone fixed in\nthe ground; thence S. 12Á E., 2 chains and 58 links; thence S. 36Á E., 2\nchains and 70 links; thence S. 63Á E., 1 chain and 82 links; thence N.\n70Á E., 10 chains and 17 links; thence N. 12Á W., to the stone first\nmentioned 5 chains and 62 links; thence N. 12Á W., 2 chains and 24 links\nto the place of beginning, containing ten acres," acquired for the\nerection of a light-house thereon.\n 3. Islands in New York harbor. Three certain islands in and about the\nharbor of New York, viz.: Bedlow's island and Ellis or Oyster island,\nbounded on all sides by the waters of the Hudson river, and Governor's\nisland, bounded on all sides by the waters of the East river and Hudson\nriver.\n 4. Great Gull and Little Gull islands, Suffolk county. Great Gull\nisland and Little Gull island, in the county of Suffolk, and bounded on\nall sides by the waters of the East river, acquired for the erection of\na light-house thereon.\n 5. Sands or Watch point, Queens county. A tract of land at Sands or\nWatch point, on Long Island, in the town of North Hempstead, county of\nQueens, described as follows: "Beginning on the easterly side of said\npoint, at a place or point in the line of ordinary high water mark,\nbeing N. 56Á E., from a large walnut or hickory tree, marked on three\nsides, standing upon the upland, and running thence (from the said point\nin high water mark) across the said point of land on a course S. 56Á W.,\nso as to pass about four feet southerly of a small marked buttonwood\ntree, standing on the bank, and passing through the center of the said\nwalnut or hickory tree marked on three sides, and through the center of\na high white oak tree marked on two sides, to ordinary high water mark\non the westerly side of said point of land; and thence to the line of\nordinary high water mark to and around the said point of land to the\npoint or place of beginning, in the line of ordinary high water mark on\nthe easterly side of said point of land, containing five acres of land,\nbe the same more or less," acquired for the erection of a light-house.\n 6. Galoo island, Lake Ontario. A tract of five acres on the head of\nGaloo island, in Lake Ontario, "Commencing 75 links S. 45Á E., from a\nlarge oak tree standing on the lake shore at a stake and stones marked\nU.S., from thence S. 45Á W., 12 chains and 90 links to a cedar stake and\nstones marked U.S., from thence northwesterly along the lake shore 11\nchains and 80 links to a point, on the edge of a large flat rock 2\nchains due south from the center of the spot fixed on for a light-house,\nfrom thence N. 45Á W., 2 chains and 65 links on a flat rock, from thence\nN. 45Á E., 5 chains and 80 links to the place of beginning," acquired\nfor the erection of a light-house thereon.\n 7. Island near Rouse's Point, Lake Champlain. A small island near\nRouse's Point, on Lake Champlain, called Island Point; and also over the\nland under the water opposite to lots number 60, 61, 62, 63, 64, 65 and\n66 of the small lots in the tract of land heretofore laid out for the\nCanadian and Nova Scotia refugees: "Beginning on the west shore of Lake\nChamplain, in the line run for the north bounds of this state, and\nrunning thence east, to the distance of 500 feet from low water's mark;\nthence southerly, keeping at the said distance of 500 feet from low\nwater's mark of said shore of Lake Champlain, and the shore of said\nisland, until a west course will strike the southwest corner of the said\nlot number sixty-six, then west to the same, and then northerly,\nfollowing the shore of the said lake, and the shore of the said island,\nto place of beginning."\n 8. At mouth of Oswego river. A tract of six acres at the mouth of the\nOswego river, and on the southerly side of the Oswego fort, in the\ncounty of Oswego, bounded as follows, viz.: "Beginning at a stake and\nstones marked L.H. standing S. 35Á W., 82 links, from the southwest\nangle of the fort; thence S. 75Á E., 9 chains and 20 links, to a stake\nand stones marked L.H., thence S. 15Á W., 7 chains 35 links, to a stake\nand stones marked L.H., thence N. 75Á W., 7 chains and 65 links, to a\nstake and stones marked L.H., standing on the bank of the lake; thence\nnortherly along said bank, to a point where the north line of the lot\nintersects said bank; thence southeasterly along said line about 48\nlinks, to the place of beginning," acquired for the erection of a\nlight-house thereon.\n 9. At mouth of Genesee river. A tract of three acres and 115 rods, at\nthe mouth of the Genesee river, on the west side thereof, being part of\nvillage lot number twenty-eight, in the village of Charlotte, in the\nformer town of Gates, and county of Monroe, bounded as follows:\n"Beginning at the easterly side of Main street, at a stake and stones\none chain southerly from the northeasterly corner of said lot number\ntwenty-eight, running thence S. 61Á 45' E., 2 chains and 50 links, to a\nstake and stones; thence N. 28Á 15' E., 1 chain, to the northerly line\nof said lot; thence S. 61Á 45' E., 8 chains and 48 links, to the said\nriver; thence S. 26Á W., along the said river, 2 chains to a stake and\nstones; thence N. 61Á 45' W., 2 chains and 50 links, to a stake and\nstones; thence S. 2 chains, to the southerly line of said lot number\ntwenty-eight; thence N. 61Á 45' W., 8 chains and 63 links, along the\nsaid line, to the said Main street; thence N. 28Á 15' E., 3 chains to\nthe place of beginning, containing three acres and 150 rods," acquired\nfor the erection of a light-house thereon.\n 10. In Sodus, Wayne county. A tract in the town of Sodus in the county\nof Wayne, bounded as follows: "Beginning on the shore of Lake Ontario,\non the east bounds of Ontario street, running thence south on the said\neast bounds of the street 9 chains and 16 links, to a cedar post at the\nnorth end of Captain Wickham's board fence; thence N. 63Á 40' E., 4\nchains and 23 links, to a cedar stake near the south point of the bank\non the north side of the flat; thence N. 40Á E., 3 chains and 37 links,\nto the shore of the lake; thence along the shore N. 36Á 30' W., 3 chains\nand 85 links; thence N. 66Á W., 3 chains and 98 links, to the place of\nbeginning; containing three acres and one-fourth, and thirty perches of\nland," acquired for the erection of a light-house thereon.\n 11. At Buffalo, Erie county. A tract of half an acre in Buffalo, Erie\ncounty, described in a deed thereof, executed by Joseph Ellicott, as\nattorney for the grantors, to the United States as follows: "All that\ncertain tract of land, situate, lying and being in the village of\nBuffalo, in the county of Niagara and state of New York, being part or\nparcel of a certain township which, on a map or survey of divers tracts\nor townships of land made for the proprietors by Joseph Ellicott,\nsurveyor, is distinguished by township number eleven, in the eighth\nrange; beginning at a stone in the northern bounds of outer lot number\nthirty-six, in said village, standing N. 48Á E., 54 links from the\nnorthwest corner of said lot, thence bounding on land conveyed to Joseph\nand Benjamin Ellicott, by deed bearing date February 29, 1812, N. 48Á\nE., 6 chains and 1 link to the southwestern bank of Buffalo creek;\nthence bounding on the said bank of the said creek, N. 87Á W., 1 chain\nand 27 links; thence by a line parallel to the northern bounds of said\nlands conveyed to Joseph and Benjamin Ellicott by deed as aforesaid, S.\n48Á W., 5 chains and 11 links to a stone, and thence S. 42Á E., 90\nlinks, to the place of beginning, containing half an acre, be the same\nmore or less," acquired for the erection of a light-house thereon.\n 12. At Oldfield point, Suffolk county. A tract of land at Oldfield\npoint, on Long Island sound, in the county of Suffolk, bounded as\nfollows: "Commencing at a stake at high water mark, from thence running\na course S. 49Á 20' W., 788 feet, to a cherry tree and fence; thence\ndown along the fence a course N. 30Á 18' W., from the cherry tree to\nhigh water mark, 245 feet; thence the same course, to low water mark;\nthence along the sound at low water mark, a northerly and easterly\ncourse round the point, to a place opposite to the place of beginning;\nand thence the first mentioned course, to the stake or place of\nbeginning," acquired for the erection of a light-house thereon.\n 13. At Throg's neck, Westchester county. A tract of land at Throg's\nneck, in the county of Westchester, bounded as follows: "Commencing at\nhigh water mark, and running a course N. 36Á 30' E., to a certain\npainted rock, and from thence the same course to high water mark, being\n766 feet; thence southerly and westerly around the point, to a painted\nrock at low water mark; thence the first mentioned course, to the place\nof beginning," acquired for the erection of a light-house thereon.\n 14. In New Utrecht, Kings county. A tract of land in the town of New\nUtrecht, Kings county, described as follows: "Beginning at the bay or\nriver on the division line of the hereby described premises, and land\nnow or late belonging to Jane Smith, and running thence along the said\ndivision line N. 58Á E., 1 chain and 50 links, to a certain stake\nstanding on the bank; thence along the said line N. 37Á E., 67 chains\nand 80 links, to certain lands now or late belonging to John S. Denyse;\nthence along the last mentioned lands S. 57Á E., 3 chains and 92 links,\nto certain lands now or late belonging to Issac Cortelyou; thence along\nthe last mentioned lands and along certain lands now or late belonging\nto Jaques Cortelyou, S. 28Á W., 37 chains 42 links; thence along the\nlast mentioned lands the five following courses, to wit, S. 38Á 40' W.,\n23 chains, to a certain rock; thence S. 41Á W., 4 chains 47 links;\nthence S. 25Á E., 3 chains and 25 links; thence S. 64Á W., 7 chains 43\nlinks; thence S. 41Á W., 1 chain and 30 links, to the bay or river\naforesaid; thence northwesterly along the said bay or river, to the\nplace of beginning; containing sixty acres, one rood and six perches of\nland;" and the second of which is bounded as follows: "Beginning at the\nsoutheasterly point of the land next before described, thence N. 62Á E.,\n180 yards; thence N. 20Á W., 75 yards; thence N. 42Á E., 310 yards;\nthence S. 60Á E., 242 yards; thence S. 25Á W., 160 yards; thence N. 60Á\nW., about 185 yards, to a point near a pond; thence S. 33Á W., 195\nyards; thence S. 53Á W., 220 yards, to the bay or river; thence along\nthe said bay, 90 yards, to the place of beginning; according to a plat\nand survey thereof, containing sixteen acres and one-half acre of land,"\nacquired for the erection of fortifications thereon.\n 15. In New Utrecht, Kings county. A tract of land in the town of New\nUtrecht, Kings county, described as follows: "Beginning at the water's\nedge at the southeast point of the first parcel of land above described;\nthence N. 41Á E., 1 chain and 30 links; thence N. 64Á E., 7 chains and\n43 links; thence N. 25Á W., 3 chains and 25 links; thence N. 41Á E., 4\nchains and 47 links; thence N. 38Á 40' E., 9 chains and 10 links; thence\nS. 60Á E., 11 chains and 69 links; thence S. 25Á W., 7 chains and 28\nlinks; thence N. 60Á W., 8 chains and 41 links; thence S. 35Á W., 8\nchains and 86 links; thence S. 53Á W., 10 chains; thence along the\nwater's edge, to the place of beginning; containing seventeen acres,\nfourteen perches and one hundred and five yards of land," acquired for\nthe erection of fortifications thereon.\n 16. In Islip, Suffolk county. A tract of land and beach, in the town\nof Islip, in the county of Suffolk, being the west end of the east\nbranch of Fire-island inlet, "beginning on the southerly side of the\nsame, at low water mark, on the Atlantic ocean, in a range of branded\nstakes; thence north thirty-two chains, to low water mark on the Great\nSouth bay, including all the land to the west of the said north line to\nFire-island inlet aforesaid, at low water mark," acquired for the\nerection of a light-house thereon.\n 17. In Haverstraw, Rockland county. A tract of land in the town of\nHaverstraw, in the county of Rockland, being the extreme point of land\ncalled Stoney-Point, on the Hudson river, "beginning at the river at\nhigh water mark, on the south side of the point, at a stake, thence\nacross the point, north four degrees west, (passing thirty-five links to\nthe west of the fort) to the river at high water mark; thence along the\nsame at high water mark round the point to the place of beginning,"\nacquired for the erection of a light-house or beacon thereon.\n 18. In Cornwall, Orange county. A certain tract of land in the town of\nCornwall, in the county of Orange, described as follows: "Beginning at\nthe northeasterly corner of the piece of land herein intended to be\ndescribed, at the mouth of a small creek which enters into the Hudson\nriver near the old stores, and thence up and along the southeasterly\nside of the said creek to its intersection with the northeasterly side\nof the road leading from West-Point to John Cronkhite's; thence\nsoutheasterly along the northeasterly side of the said road to its\nintersection with the road which leads from West-Point southerly to the\nWidow Kinsley's; thence from said point of intersection due south, to a\npoint 7 chains south of the line which divides the Gridley farm from the\npost of West-Point; thence S. 81Á E., to the Hudson's river, on a line\nparallel with the said division line; and from thence northwardly along\nthe low water mark of the said river, to the place of beginning,\ncontaining two hundred and twenty acres or thereabouts."\n 19. In Lyme, Jefferson county. A certain tract of land in the town of\nLyme in the county of Jefferson, being the extreme point of land called\nTibbets' point, described as follows: "Beginning at a stake standing on\nthe extreme point thereof, on the bank of Lake Ontario; thence N. 7Á 30'\nE., 5 chains to a basswood sapling cornered; thence S. 82Á 30' E., 5\nchains and 50 links to a stake cornered, 10 links southwesterly from a\nmaple tree blazed; thence S. 7Á 30' W., 7 chains and 50 links to a stake\non the bank of Lake Ontario, 9 links southerly from a walnut tree\nblazed; thence N. 49Á 45' W., 5 chains and 99 links to an angle; thence\nS. 70Á 30' W., 97 links to the place of beginning, containing two acres\nand ninety-six hundredths of an acre of land," acquired for the erection\nof a light-house thereon.\n 20. On Plumb island, Suffolk county. A tract of land containing three\nacres, on the south side of the west end of Plumb island, in the county\nof Suffolk, and described as follows: "Beginning at low water mark,\nopposite a rock on the edge of the upland, marked U.S. 1826, and running\nthence north four degrees east, six chains and three links to a stake on\nthe hill; thence running south seventy-nine degrees west, over a rock at\nthe bottom of the bank marked U.S. to the west point of said island to\nlow water mark; thence southeastwardly along the shore at low water mark\nto the place of beginning, opposite to the first mentioned rock, butted\nand bounded northwardly and eastwardly by lands of Richard Jerome;\nsouthwardly and westwardly by the waters of Gardiner's bay and Plumb\nGut;" acquired for the erection of a light-house thereon.\n 21. On North Brothers island, Queens county. A tract of land at the\nwestern extremity of North Brothers island, in Long Island sound, county\nof Queens, containing not less than one nor more than five acres,\nacquired for the erection of a light-house thereon.\n 22. In Esopus, Ulster county. A tract of land under water in the town\nof Esopus, Ulster county, at or near the junction of the Roundout and\nHudson rivers, not exceeding two acres in area, acquired for the\nerection of a light-house or beacon light thereon.\n 23. At Esopus meadows, Ulster county. A tract of land in the town of\nEsopus, in the county of Ulster, at a place called the Esopus meadows or\nflats, in the Hudson river, and covered with the waters, and which is\ndescribed as follows: "Beginning at a point on the west side of the\nchannel of the Hudson river, on the edge of the said channel, in\neighteen inches water at low water, from whence a course S. 2Á E. will\nstrike the northwest corner of Governor Lewis's dock, and a course N. 2Á\nE. will strike the window in the store on Thompson's dock, and a course\nS. 43Á E. will strike the northeast corner of Emmet's house, and a\ncourse N. 65Á W. will strike a small house on the west side of the\nriver, occupied by Henry Terpenning, and a course S. 27Á W. will strike\nthe store on Degraff's dock; thence from said point down the river five\nchains; thence towards the west bank of the river at right angles to the\nfirst course five chains; thence with a course parallel to the first\ncourse five chains; thence with a course parallel to the second course\nfive chains, to the place of beginning," acquired for the erection of a\nlight-house thereon.\n 24. In the city of Buffalo, Erie county. A tract of land in the city\nof Buffalo on the east side of the Niagara river, described as follows:\n"Beginning at the point of intersection of the westerly line of the\nLockport and Buffalo railroad with the southerly line of lot number\neight of the state reserve; thence N. 82Á 10' W., 75 feet, more or less,\nto the towing path of the Erie canal enlargement; thence N. 2Á 10' E.,\n75 feet; thence S. 82Á 10' E., 75 feet, more or less, to the Lockport\nand Buffalo railroad; thence S. 2Á 10' W., 75 feet, to the place of\nbeginning," acquired for the erection of a light-house or beacon\nthereon.\n 25. In the bay of New York. A tract of land, being such portion of the\nlands under water comprising what is known as West bank, in the lower\nbay of the port of New York, and Old Orchard shoals, required and\noccupied by the United States in the erection thereon of wharves and\nwarehouses for the reception of goods and merchandise arriving in such\nport in vessels subject to quarantine by the laws of this state.\n 26. David's island, New Rochelle. A tract of land situate in the\nharbor of New Rochelle, and known as David's island, acquired by the\nUnited States to be used for military purposes.\n 27. At West Point, Orange county. Certain tracts of land at West\nPoint, Orange county, acquired by the United States prior to May 15,\n1875, for the erection and maintenance thereon of forts, arsenals, docks\nand piers, military academy, hospitals and other needful buildings, and\nfor the maintenance of the national cemetery and an observatory.\n 28. For aids to navigation on Old Orchard shoal. For the purpose of\nestablishing thereon lights or other aids to navigation on Old Orchard\nshoal; a tract of land under water inclosed by a circle of two hundred\nfeet in diameter, the center of which shall be located as follows: the\nangle included between the ranges to Romer light and Sandy Hook light\nshall be thirty-five degrees and four minutes, the angle between the\nranges to Sandy Hook light and Waackaack beacon shall be seventy-nine\ndegrees and two minutes.\n 29. For fish preserve, Cape Vincent. All that tract or parcel of land,\nsituate in the village and town of Cape Vincent, county of Jefferson,\nand state of New York, and bounded as follows, viz.: "Beginning in the\nnorth margin of Broadway at the southwesterly corner of the Lee\nhomestead lot and running thence along the north margin of Broadway\nsouth seventy-one degrees west, one hundred and ten feet to the\nsoutheasterly corner of the Peo lot; thence north nineteen degrees, west\nalong the easterly boundary line of the Peo lot, and also the Clark lot,\nand continued on the same course parallel with Murray street to the\nriver Saint Lawrence a distance of about three chains; thence along the\nsaid river easterly to the northwesterly corner of the said Lee\nhomestead lot; thence south nineteen degrees, east, along the west\nboundary line of the Lee homestead lot, two chains, ninety links, to the\nplace of beginning, being all the land, buildings, appurtenances,\nprivileges, water rights, docks and cribs lying northerly of said\nBroadway and between the easterly and westerly boundary lines\nhereinbefore given, extended to include all water lot frontage, rights,\nprivileges and erections upon, along, or in front of said one hundred\nand ten feet; also the already well-defined roadway leading from Murray\nstreet to the said mill lot hereinbefore bounded and described, subject,\nnevertheless, to the right of way thereon to and from the wharf lying\nwesterly of said mill to persons doing business at said wharf.\n
