§ 388. Limitation on powers of the authority. A department, authority,\ndivision or agency of the state shall not offer or permit any officer or\nemployee of such department, authority, division or agency to use a pass\nto access and/or use the thruway without the officer's or employee's\npersonal payment of tolls except when the use of such a pass and/or use\nof the thruway without personal payment of tolls occurs in the normal\ncourse of the employment or duties of such officer or employee. This\nsection shall not diminish the rights of any employee pursuant to a\ncollective bargaining agreement.\n
