§ 1020-kk. Semi-annual expenditure and lobbying report. 1. On or\nbefore March thirty-first, two thousand twenty-two and every semi-annual\nperiod thereafter:

On or\nbefore March thirty-first, two thousand twenty-two and every semi-annual\nperiod thereafter: (a) the authority shall report to the governor, the\ntemporary president of the senate and the speaker of the assembly\nregarding advertising and lobbying on behalf of the authority by the\nauthority, the trustees of the authority, or any employee of the\nauthority; and (b) any service provider of the authority shall report to\nthe governor, the temporary president of the senate and the speaker of\nthe assembly regarding advertising and lobbying on behalf of the\nauthority, or in connection with the service provider's provision of\nmanagement and operation services or the operation of the authority's\nelectric transmission and distribution system.\n 2. For the purposes of this title, the following terms shall have the\nfollowing meanings:\n (a) Lobbying shall mean any attempt to influence:\n (i) the passage or defeat of any legislation or resolution by either\nhouse of the state legislature including but not limited to the\nintroduction or intended introduction of such legislation or resolution\nor approval or disapproval of any legislation;\n (ii) the adoption, issuance, rescission or modification of a\ngubernatorial executive order;\n (iii) the adoption or rejection of any rule or regulation having the\nforce and effect of law by a state agency;\n (iv) the passage or defeat of any local law, ordinance, resolution, or\nregulation by any municipality;\n (v) the adoption, issuance, rescission, modification or terms of any\nexecutive order issued by the chief executive officer of a municipality;\nand\n (vi) the adoption or rejection of any rule, regulation, or resolution\nhaving the force and effect of a local law, ordinance, resolution or\nregulation.\n (b) Advertising shall mean any promotional activity or public service\nannouncement that requires the purchase of media space, including\ntelevision airtime, radio airtime, internet media space, billboards,\nnewspaper space, magazine space or any private publication which\nrequires the expenditure of any public funds.\n 3. The authority and its service providers shall prepare separate\nreports to include the following information:\n (a) For lobbying, such report shall include, but not be limited to:\nthe name of the trustee, employee of the authority or service provider\nengaging in lobbying; the name of the public official or public employee\nthat was lobbied; the date and time of the meeting or communication; the\nsubject matter of the lobbying, and any expenses incurred by the\nauthority or its service provider for travel, lodging, or meals in\nconnection with such lobbying.\n (b) For advertising, such report shall include, but not be limited to,\nitemization of any public funds spent on advertising and information\npertaining to the advertising marketing plan including measurable goals\nand objectives for the advertising campaign.\n 4. The requirements of this section shall not be construed to require\nthe disclosure of information that is otherwise protected from\ndisclosure by any law, regulation, order, or the civil practice law and\nrules.\n
