§ 1020-g. Powers to provide and maintain generating, transmission and\nresource recovery waste to energy facilities. Without limiting the\ngenerality of the powers conferred upon the authority by section one\nthousand twenty-f of this title, the authority shall have the specific\npower:\n (a) Subject to the provisions of subdivision one of section ten\nhundred twenty-s of this title, to acquire, construct, improve,\nrehabilitate, maintain and operate such generating, transmission and\nrelated facilities as the authority deems necessary or desirable to\nmaintain an adequate and dependable supply of gas and electric power\nwithin the service area;\n (b) Subject to the provisions of subdivision one of section ten\nhundred twenty-s of this title, to acquire, construct, improve,\nrehabilita

Without limiting the\ngenerality of the powers conferred upon the authority by section one\nthousand twenty-f of this title, the authority shall have the specific\npower:\n (a) Subject to the provisions of subdivision one of section ten\nhundred twenty-s of this title, to acquire, construct, improve,\nrehabilitate, maintain and operate such generating, transmission and\nrelated facilities as the authority deems necessary or desirable to\nmaintain an adequate and dependable supply of gas and electric power\nwithin the service area;\n (b) Subject to the provisions of subdivision one of section ten\nhundred twenty-s of this title, to acquire, construct, improve,\nrehabilitate, maintain and operate such hydroelectric or energy storage\nprojects within the state as it deems necessary or desirable to\ncontribute to the adequacy, economy and reliability of the supply of\nelectric power and energy or to conserve fuel;\n (c) Subject to the provisions of subdivision one of section ten\nhundred twenty-s of this title, to determine the location, type, size,\nconstruction, lease, purchase, ownership, acquisition, use and operation\nof any generating, transmission or other related facility, provided,\nhowever, that in making such determinations relating to electric power\nfacilities the authority shall give primary consideration to the\nconstruction of energy efficient facilities, energy conservation, load\nmanagement programs, and cogeneration in the service area;\n (d) To proceed with the physical construction or completion of any\ngenerating, transmission or related facility;\n (e) To apply to the appropriate agencies and officials of the federal\nand state governments, for such licenses, permits or approval of its\nplans or projects as it may deem necessary or advisable, and to accept\nsuch licenses, permits or approvals as may be tendered to it by such\nagencies or officials, upon such terms and conditions as it may deem\nappropriate;\n (f) To institute suit, or to apply to any legislative body for\nlegislation, or to take such other action as it may deem necessary or\nadvisable in the furtherance of the purposes of this title and for the\nprotection of its rights, if for any reason the authority shall fail to\nsecure any such license, permit or approval as it may deem necessary or\nadvisable;\n (g) To study means of maintaining the customer base in, and attracting\ncommerce and industry to the service area;\n (h) To implement programs and policies designed to provide for the\ninterconnection of: (i) (A) solar electric generating equipment owned or\noperated by residential customers, (B) farm waste electric generating\nequipment owned or operated by customer-generators, (C) solar electric\ngenerating equipment owned or operated by non-residential customers, (D)\nmicro-combined heat and power generating equipment owned, leased or\noperated by residential customers, (E) fuel cell electric generating\nequipment owned, leased or operated by residential customers, and (F)\nmicro-hydroelectric generating equipment owned, leased or operated by\ncustomer-generators and for net energy metering consistent with section\nsixty-six-j of the public service law, to increase the efficiency of\nenergy end use, to shift demand from periods of high demand to periods\nof low demand and to facilitate the development of cogeneration; and\n(ii) wind electric generating equipment owned or operated by\ncustomer-generators and for net energy metering consistent with section\nsixty-six-l of the public service law.\n (i) To develop, with public participation, a comprehensive least-cost\nplan which shall consider practical and economical use of conservation,\nrenewable resources, and cogeneration for providing service to its\ncustomers;\n (j) To cooperate with and to enter into contractual arrangements with\nprivate utility companies or public entities:\n (i) with respect to the construction and operation of facilities by\nthe authority and the sale of all or part of the output therefrom;\n (ii) with respect to the construction, completion, acquisition,\nownership and/or operation of generating facilities, fuel, docks,\nsidings, loading or unloading equipment, storage facilities and other\nsubsidiary facilities and the disposition of the output of such\ngenerating facilities; and\n (iii) with respect to the construction, acquisition, ownership,\noperation and/or use of transmission facilities;\n (k) To cooperate with and to enter into contractual arrangements with\nmunicipalities with respect to the construction, improvement,\nrehabilitation, ownership and/or operation of generating facilities;\n (l) To cooperate with and to enter into contractual arrangements with\nthe New York state energy research and development authority in\nconnection with the planning, siting, development, construction,\noperation and maintenance of generating facilities of the authority\nutilizing new energy technologies;\n (m) Subject to the provisions of section ten hundred twenty-aa of this\ntitle, to construct, maintain and operate resource recovery waste to\nenergy facilities; and\n (n) After the establishment of Long Island Power Authority (LIPA) and\nthe commencement of its function as a utility, LIPA shall acquire from\nLILCO all franchise and utility service responsibilities for all\nultimate consumers of gas and electricity within LILCO's former service\nterritory, including the responsibility to provide safe and adequate\nservice.\n
