§ 130.79. Fraudulent enlistment, appointment, or separation. Any\nperson who--
(1)procures his own enlistment or appointment in the\norganized militia by means of knowingly false representations or\ndeliberate concealment as to his qualifications for such enlistment or\nappointment and receives pay or allowances thereunder; or\n (2) procures his own separation from the organized militia by means of\nknowingly false representations or deliberate concealment as to his\neligibility for such separation;\nshall be punished as a court-martial may direct.\n
