* § 13.41 Integrated employment plan.\n (a) The commissioner, in consultation with the developmental\ndisabilities advisory council, shall establish a plan to increase\nemployment opportunities for people with developmental disabilities. The\nplan shall include, but not be limited to:\n (1) identification of strategies to increase competitive employment\nopportunities for individuals with developmental disabilities, including\nstudents transitioning from educational programs;\n (2) data concerning job retention among individuals with developmental\ndisabilities and the identification of strategies to increase job\nretention;\n (3) identification of models of integrated employment promoting, to\nthe greatest extent possible, individuals with developmental\ndisabilities working alongside individuals without disabilities,\nincluding considerations of ability levels, critical life transitions\nand appropriate options;\n (4) strategies for assisting individuals in transitioning from\nsheltered workshop programs to competitive employment;\n (5) partnerships with business communities and senior services to\nassist in increasing the availability of competitive employment for\nolder adults;\n (6) identification of means to assist individuals with significant\nbehavioral or medical needs in preparing for and moving towards\nintegrated employment;\n (7) technical assistance, compliance and transition assistance\nprocedures for existing providers who seek to transition to competitive\nand/or integrated employment models; and\n (8) assessments of funding and necessary supports for individuals and\nproviders.\n (b) The commissioner, in consultation with the developmental\ndisabilities advisory council, shall develop the plan with input from\nstakeholders, including individuals with developmental disabilities,\nparents and guardians of individuals with developmental disabilities,\nadvocates and providers of services for individuals with developmental\ndisabilities.\n (c) The plan required pursuant to this section shall be developed and\nsubmitted to the temporary president of the senate and speaker of the\nassembly and posted on the website of the office for people with\ndevelopmental disabilities within one hundred eighty days of the centers\nfor medicare and medicaid services' approval of the plan to increase\ncompetitive employment opportunities for people with developmental\ndisabilities.\n (d) Individuals with developmental disabilities who were employed in\nsheltered workshops on or after July first, two thousand thirteen who\nare not interested in working or who are not able to work in a\nprovider-owned business or private business in the community shall, to\nthe extent practicable and in accordance with the principles of\nperson-centered planning, be afforded the option of receiving other\nservices of the office, including, but not limited to pathway to\nemployment, community prevocational, day habilitation, community\nhabilitation and self-directed services. The provision of such services\nshall consider, but not be limited to, the following factors:\n (1) assessment of the individual's skills, including social behavior,\nability to handle stress, ability to work with others, job performance,\ncommunication skills, work ethic, and interests;\n (2) assessment of the individual's situation, including transportation\nneeds, family supports, and physical and mental health; and\n (3) creation of opportunities to explore different community and\nvolunteer experiences to obtain information that will be used to create\na person-centered plan.\n (e) For individuals with developmental disabilities who were employed\nin sheltered workshops on or after July first, two thousand thirteen\ninterested in retirement, office services shall focus on connecting\nindividuals to retirement-related activities, including participating in\nsenior and community center activities, and other local activities for\nretirees.\n * NB There are 2 § 13.41's\n
