§ 19-0909. Interim control target.\n 1. a. In the absence of a controlling federal statute or program which\nthe commissioner determines is consistent with the purpose and intent of\nthis title, the department shall promulgate, no later than January\nfirst, nineteen hundred eighty-six, an interim control target for the\ncontrol of sulfate deposition at each sensitive receptor area where the\nenvironmental threshold value is exceeded, and rules and regulations\nnecessary to implement such targets.\n b. Any such interim control target promulgated pursuant to this\nsection shall take effect on January first, nineteen hundred\neighty-eight, and all facilities and stationary sources shall be in\ncompliance with the interim control target by such date.\n c. In connection with the promulgation of an interim control target,\nthe department shall prepare an analysis of the economic impact of the\nimplementation of such target.\n 2. The department shall not require or prohibit any particular control\ntechnique to achieve any such interim control target, but shall allow\nthe use of any or all reasonable sulfur dioxide emission control\ntechniques, including but not limited to:\n a. The substitution of lower sulfur content fossil fuels.\n b. One or more combinations of blending various sulfur content fossil\nfuels.\n c. The precombustion cleaning of coal.\n d. The conversion or modification of an existing boiler to a boiler\ncapable of burning a lower-sulfur content coal.\n e. The use of best available control technology at the time of\nconstruction, reconstruction or substantial addition to or alteration of\na facility or stationary source.\n f. The installation of flue gas desulfurization equipment.\n g. The installation of fluidized bed boilers.\n h. For persons operating multiple boilers, the coordinated operation\nof these boilers to minimize the discharge of sulfur dioxide from them.\n i. The use of least emissions dispatch.\n j. The decommissioning of a facility or stationary source.\n k. The purchasing of electricity or steam from another person, so as\nto lessen the operation of a facility or stationary source, provided\nsuch purchase does not contribute to a net increase in acid deposition\nin sensitive receptor areas.\n l. The implementation of energy conservation measures to lessen the\namount of operation of a facility or stationary source.\n
