Text

1. At the place, date and hour specified for the hearing in the notice or at any subsequent time to which the hearing may be adjourned, the governing body shall give full consideration to all written objections which have been filed and shall hear all owners of real property within the proposed service district desiring to be heard. 2. If the governing body determines after the hearing that an existing or a new electric facility must be placed underground and that:

(a)The requirements for the establishment of a service district have been satisfied;
(b)Objections have not been filed in writing by more than 40 percent of the owners of real property within the proposed service district, or by owners of more than 40 percent of the real property on a square foot basis in the proposed service
