1. A person shall not own all or any portion of an optometry practice under an assumed or fictitious name unless the person:

(a)Holds an active license to practice optometry in this State; and
(b)Has been issued a certificate of registration by the Board to practice optometry under the assumed or fictitious name and at a specific location. 2. A person who applies for a certificate of registration to own all or any portion of an optometry practice under an assumed or fictitious name must submit to the Board an application on a form provided by the Board. The application must be accompanied by proof satisfactory to the Board that the assumed or fictitious name has been registered or otherwise approved by any appropriate governmental entity, including, without limitation, any incorporated c
