Text

1. Except as otherwise provided in subsection 2, a physician or advanced practice registered nurse shall prescribe for an injured employee a generic drug in lieu of a drug with a brand name if the generic drug is biologically equivalent and has the same active ingredient or ingredients of the same strength, quantity and form of dosage as the drug with a brand name. 2. A physician or advanced practice registered nurse is not required to comply with the provisions of subsection 1 if:

(a)The physician or advanced practice registered nurse determines that the generic drug would not be beneficial to the health of the injured employee; or
(b)The generic drug is higher in cost than the drug with a brand name.
