In any county whose population is 700,000 or more: 1. Except as otherwise provided in subsection 2, nothing in this chapter requires the board or a subcontracting agency to furnish water for the purpose of filling or maintaining an artificially created lake or stream where that use of water is prohibited or restricted by ordinance of:

(a)The county, if the lake or stream is located within the unincorporated areas of the county; or

(b)A city, if the lake or stream is located within the boundaries of the city. 2. The provisions of subsection 1 and of any ordinance referred to in subsection 1 do not apply to:

(a)Water stored in an artificially created reservoir for use in flood control, in meeting peak water demands or for purposes relating to the treatment of sewage;
