1. The State Engineer may consider the consumptive use of a water right and the consumptive use of a proposed beneficial use of water in determining whether a proposed change in the place of diversion, manner of use or place of use complies with the provisions of subsection 2 of NRS 533.370 . 2. The provisions of this section:
(a)Must not be applied by the State Engineer in a manner that is inconsistent with any applicable federal or state decree concerning consumptive use.
(b)Do not apply to any decreed, certified or permitted right to appropriate water which originates in the Virgin River or the Muddy River.
