Text

1. Except as otherwise provided in subsection 2, after a person is arrested for the commission of a traffic violation pursuant to chapters 484A to 484E , inclusive, of NRS, there is a presumption that the person should be released on his or her own recognizance. 2. The presumption established in subsection 1 does not apply if:

(a)A person is arrested for:
(1)Reckless driving in violation of NRS 484B.653 ;
(2)Vehicular manslaughter in violation of NRS 484B.657 ; or
(3)Driving, operating or being in actual physical control of a vehicle, a power-driven vessel or a sailing vessel under way while under the influence of intoxicating liquor or a controlled substance in violation of NRS 484C.110 , 484C.120 or 488.410 , as applicable; or
(b)The court determines that a person is willfully refus
