Text
1. It is unlawful for any person to:
(a)Construct, substantially alter or operate any facility for the treatment, storage or disposal of hazardous waste; or
(b)Treat, store or dispose of any hazardous waste,
Ê unless the person has first obtained a permit from the Department to do so.
2. A person who:
(a)Conducts an activity for which a permit is required pursuant to this section, and is doing so on the effective date of the regulations establishing procedures for the system of permits; and
(b)Has made an application for a permit,
Ê shall be deemed to have been issued a permit until his or her application has been acted upon, unless a delay in that action was caused by the person’s failure to furnish information which was reasonably requested or required for the processing of the appli
