Text

1. The State Department of Conservation and Natural Resources is hereby designated the state agency for such purposes as are required by the Resource Conservation and Recovery Act of 1976, 42 U.S.C. §§ 6941 et seq., except that:

(a)The State Environmental Commission has the exclusive authority to adopt regulations pursuant to NRS 444.440 to 444.620 , inclusive; and
(b)The district boards of health of health districts created pursuant to NRS 439.362 or 439.370 retain the authority to issue permits and adopt regulations pursuant to NRS 444.580 . 2. The State Department of Conservation and Natural Resources may take any action necessary and appropriate to secure the benefits of any federal law relating to solid waste.
