If a sheriff neglects or refuses to pay over on demand to the person entitled thereto any money which may come into the sheriff’s hands by virtue of his or her office, after deducting his or her legal fees, the amount thereof, with 25 percent damages, and interest at the rate of 7 percent per annum from the time of the demand, may be recovered by such person from him or her and the sureties on his or her official bond, on application, upon 5 days’ notice to the court in which the action is brought.
